The following are the general rules:
Every Divorce that is granted in Kentucky must have a VS 300 form. Most
courts also require a Mandatory case disclosure and a case data sheet as well.
These documents can be gotten from your court clerk in the county you live in.
You will also need a summons for the sheriff if you serve by sheriff. If
the spouse can not be found you may use a warning order attorney motion to get a
default but there is a fee. A warning order attorney will attempt to find
the spouse and then report to the clerk that the spouse could not be found and
you will owe a separate fee for that.
If children are involved you must serve the respondent and wait 60 days
before the proof (testimony or discovery) can be taken and a divorce is granted.
Every settlement agreement involving children must state that child support had
been calculated in accords with the child support guideline chart and
considered. You may have a different amount if it is fair but you have to
look it up.
Custody may be sole or joint and
joint with primary custody is common.
